deCervo's Neural Data Policy

This agreement (hereafter, “deCervo’s Neural Data Policy” or “Neural Data Policy”), together with Terms of Service, Privacy Policy and any other descriptions provided in Policies describes deCervo’s policies on the collection, use, and disclosure of your information in connection with your Neural Data (see Terms of Service) when using the Service. We provide this Neural Data Policy to help you make an informed decision about whether to use this part our Service. When you use the Service, you accept deCervo’s policies and practices regarding the collection, use, and disclosure of your information as described in this Neural Data Policy and applicable law.

If you do not agree with the policies and practices described in the Neural Data Policy, you may choose not to use the Service in this way.


Procedures to be Followed
You will be seated in front of a computer monitor or device running software of the Service. You will be asked to view and/or hear a series of images and/or sounds produced by the Service. During this, we will use sensors to record changes in your brain waves. To measure changes in your brain waves, a head piece which holds the sensors next to your head will be fitted to your scalp. These brain wave sensors (“EEG Equipment”) require an application of an electrode gel/cream to help establish a connection between the sensors and your skin. A blunt needle may be used to help the gel connect the electrode to your skin. The EEG Equipment will be attached and monitored by deCervo personnel and/or other trained personnel (collectively, “Trained Personnel”) at all times.

During the study, you will interact with games and/or other aspects of the Service (e.g., images and/or sounds). The Trained Personnel will be able to monitor you and the EEG Equipment throughout your use of the Service when Neural Data is being collected. It is possible that video of you using the Service this way will be recorded for analysis purposes only. You will be able to take breaks as needed. Any Neural Data collected will never be used in conjunction with your name or any identifiable information unless you give permission to Us to do so.


Discomforts and Risks
Your health and safety are important to Us. The EEG Equipment used in the study is a passive recording device, and has no known risks. The Trained Personnel will be alert to signs you show of discomfort and will do whatever is necessary to eliminate discomforts and assure your safety. If you experience any discomfort arising from the sensors as they are attached and during the session, please tell the Trained Personnel. Even so, because of the procedure in the study the following discomforts and risks are possible:

-The electrode gel may cause skin irritation for some participants.

-The electrode gel eye may cause irritation if it gets into your eyes.

-Minimal discomfort can arise from the blunt needle (if used) used to place the EEG gel on your scalp.

-You could suffer an allergic reaction if you are allergic to rubbing alcohol. If you are allergic to rubbing alcohol, please alert the investigators, as you will not be able to participate in using this aspect of the Service.


Duration
Each use of the Service in the collection of Neural Data comprises a session (“Session”). One Session should take no more than 1 hour to complete.


Confidentiality
All Neural Data and any other PHI (collectively, “PHI User Content”) obtained about you will be considered privileged and held in confidence. If a third-party requests access to your PHI User Content then you will be given the opportunity to share or not to share this data.

If PHI User Content are published or presented to anyone, no personally identifiable information will be shared. Publication of PHI User Content in a journal or technical report, or presentation at a meeting, will not reveal personally identifiable information nor any information about third-parties with access to your PHI User Content. We will make every effort not to share identifiable information with anyone outside deCervo or third-parties approved by you to access such information.


Voluntary Participation
Your decision to participate in this part of the Service is yours. You can stop at any time.

You must be 18 years of age or older to take part in this use of the Service. If you are under 18 years of age then you represent that your legal guardian has reviewed and agreed to this Neural Data Policy and any other terms described in our Policies.
